Terms of Use

These Terms of Use (“Terms”) govern your access to and use of NotifyLandlord (the “Service”), a property-management application provided by Merseyside Property Ltd (“NotifyLandlord”, “we”, “us”). By creating an account or using the Service, you agree to these Terms. If you are agreeing on behalf of a business, you confirm you are authorised to bind that business.
1. The Service
NotifyLandlord helps landlords and letting businesses manage properties, tenancies, compliance, rent ledgers, documents and communications. We may add, change or remove features from time to time to improve the Service.
2. Accounts and eligibility
- You must provide accurate account information and keep it up to date.
- You are responsible for your account, for the actions of users you invite, and for keeping login credentials secure.
- The Service is for business use by users aged 18 or over.
- You must enable and use any security features we require, including multi-factor authentication where prompted.
3. Your responsibilities and acceptable use
You agree not to:
- use the Service unlawfully, or to store or process data you have no right to;
- upload malicious code, attempt to gain unauthorised access, or disrupt the Service;
- reverse engineer, resell or misrepresent the Service; or
- use the Service in a way that infringes the rights of others.
You are responsible for the data you and your users put into the Service and for having a lawful basis to do so. Where you manage data about tenants, applicants or other individuals, you are the data controller for that data and we act as your processor, as described in our Privacy Policy.
4. Bank connections
If you connect a bank account, you do so through Plaid and authenticate directly with your bank. That access is read-only and used to reconcile incoming payments; we do not move money on your behalf. You are responsible for ensuring you are authorised to connect any account you link, and you can disconnect it at any time. Bank connections are also subject to Plaid's own terms and privacy policy.
5. Fees
Where the Service (or parts of it) is offered on a paid basis, the applicable fees, billing period and payment terms will be presented to you before you subscribe. Unless stated otherwise, fees are non-refundable except where required by law.
6. Intellectual property
We and our licensors own all rights in the Service, including its software, design and content. We grant you a non-exclusive, non-transferable right to use the Service during your subscription. You retain all rights in the data you upload (“Your Content”), and you grant us the limited rights needed to host and process it to provide the Service.
7. Third-party services
The Service integrates with third parties (including Plaid, Google/Gmail and DocuSign). Your use of those integrations may be subject to the third party's own terms, and we are not responsible for third-party services.
8. Availability
We aim to keep the Service available and reliable but do not guarantee it will be uninterrupted or error-free. We may suspend the Service for maintenance, or to protect the Service or its users.
9. Disclaimers
The Service is provided “as is”. It is a management tool and does not constitute legal, financial or tax advice. You remain responsible for meeting your own legal obligations as a landlord or agent, including compliance, safety and record-keeping requirements. To the extent permitted by law, we exclude all implied warranties.
10. Limitation of liability
Nothing in these Terms limits liability that cannot be limited by law. Subject to that, we are not liable for loss of profits, loss of data, or indirect or consequential loss; and our total liability arising out of or in connection with the Service is limited to the fees you paid to us in the twelve months before the event giving rise to the claim.
11. Termination
You may stop using the Service and close your account at any time. We may suspend or terminate your access if you breach these Terms or where we are required to by law. On termination, your right to use the Service ends; data handling on closure is described in our Privacy Policy and data retention practices.
12. Changes to these Terms
We may update these Terms from time to time. We will change the “last updated” date above and, where changes are significant, take reasonable steps to notify you. Continued use of the Service after changes take effect means you accept the updated Terms.
13. Governing law
These Terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction, save that you may also have rights to bring proceedings in your local courts where required by law.
